Characterization & Division of Assets

California is a community property state. Separate property are assets owned prior to the date of marriage, acquired after the date of separation, or after the date of marriage and prior to the date of separation by way of inheritance or gift as defined by the California Family Law Code. Community property assets are acquired after the date of marriage and prior to the date of separation unless acquired by way of inheritance or gift as defined by California law. A divorce may involve very few community assets or very complex assets but will be divided according to the law.
